Waiver of Liability, Assumption of Risk & Release Agreement

Backtrail Adventures, LLC

PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.

I hereby acknowledge that I have voluntarily agreed to participate in a guided off-road tour (the “Activity”) provided by Backtrail Adventures, LLC (“Company”), including but not limited to dirtbike and side-by-side (UTV) riding in natural terrain, including desert and forest environments.

1. Acknowledgment of Risks

I fully understand and acknowledge that:

• Off-road motorized activities are inherently dangerous and involve risks of serious injury or death, including but not limited to: collision with terrain, obstacles, or other participants; vehicle failure; heat stroke; dehydration; animal encounters; and negligence by me or others.

• The Activity occurs in unpredictable and hazardous terrain and weather conditions.

• Backtrail Adventures does not own or provide the vehicles used in the tour, unless otherwise stated. I am solely responsible for ensuring my vehicle is safe and properly maintained.

2. Release of Liability & Indemnification

I hereby voluntarily release, waive, and discharge Backtrail Adventures, LLC and its owners, guides, employees, agents, affiliates, contractors, successors, and assigns (“Released Parties”) from any and all claims, actions, demands, losses, liabilities, damages, expenses or causes of action (including attorney’s fees) for injury, illness, death, or property damage that may arise from or relate in any way to my participation in the Activity, whether caused by negligence or otherwise.

I further agree to indemnify, defend, and hold harmless the Released Parties from any and all claims brought by me or on my behalf, or by any third party arising out of or in connection with my participation.

3. Medical Fitness & Insurance

I certify that:

• I am in good physical health and able to safely participate in the Activity.

• I will not participate under the influence of alcohol or drugs.

• I carry adequate medical and liability insurance or accept full financial responsibility for any injuries I may sustain.

4. Photography & Media Release

I grant Backtrail Adventures permission to use any photographs, videos, or likenesses taken during the Activity for marketing, promotional, or informational purposes, without compensation.

5. Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the State of Arizona. Any disputes shall be resolved exclusively in the courts of Maricopa County, Arizona.

6. Acknowledgment & Entire Agreement

I have read this agreement carefully and understand that it is a release of liability, waiver of legal rights, and assumption of risk. I sign it voluntarily and knowingly. This document represents the entire agreement between myself and Backtrail Adventures and supersedes all prior discussions.
